Mittai Bandi – Terms of Service

I. Acceptance of Terms

Thank you for using Mittai Bandi. These Terms of Service (the “Terms”) explain your legal rights and responsibilities when you access or use the Mittai Bandi website at www.mittaibandi.com (the “Site”) and the Mittai Bandi mobile application and any related software, whether existing now or introduced in future (together, the “Mittai Bandi Platform” and, with all the features and services offered through it, the “Services”).

These Terms apply to all existing and future customers of Mittai Bandi.

Please read these Terms carefully. By accessing or using the Mittai Bandi Platform, you agree to be bound by these Terms and enter into a legally binding contract with Gurmitraa Technologies Pvt Ltd, the parent company of Mittai Bandi, and/or its affiliates (together, “Mittai Bandi”, “we”, “us” or “our”). If you do not accept these Terms, or are unable to be bound by them, you must not use the Services. You use the Mittai Bandi Platform at your own risk, including the risk of encountering content that you find objectionable or inappropriate.

You can accept these Terms by:

• Clicking to accept or agree to the Terms wherever we present them to you in the user interface for a particular Service; or
• Actually using the Services. In this case, you understand and agree that we will treat your use of the Services as your acceptance of the Terms from that point onwards.

II. Definitions

• Customer: “Customer”, “You” or “Your” means you, as a user of the Services. A Customer is anyone who accesses or uses the Services to browse, order, transact, share, display, host, publish or upload information, views or pictures, and includes any other person who jointly takes part in using the Services.
• Content: Includes (but is not limited to) reviews, ratings, images, photos, audio, video, location data, nearby places, messages and all other forms of information or data.
  • “Your Content” or “Customer Content” means content you upload, share or transmit to, through or in connection with the Services, such as ratings, reviews, images, photos, messages, chat communications and profile information.
  • “Mittai Bandi Content” means content that we create and make available in connection with the Services, including visual interfaces, interactive features, graphics, design, compilation, computer code, products, software, aggregate ratings, reports and usage-related data, and all other elements and components of the Services, excluding Your Content and Third Party Content.
  • “Third Party Content” means content that comes from parties other than Mittai Bandi or its Customers, such as Partner Shops, and is made available through the Services.
• Partner Shop(s): The independent sweet shops, bakeries, confectioners, snack makers and other food businesses that are listed on the Mittai Bandi Platform and sell their products to Customers through it.
• Delivery Partner(s): The independent third-party persons or entities who deliver orders to Customers, whether engaged by Mittai Bandi or by a Partner Shop.

III. Eligibility to Use the Services

You represent and warrant that you are at least eighteen (18) years old and fully able and competent to understand and agree to the terms, conditions, obligations, affirmations, representations and warranties set out in these Terms.

You comply with all laws and regulations of the country in which you live when you access and use the Services. You agree to use the Services only in compliance with these Terms and applicable law, and in a way that does not violate our legal rights or those of any third party.

IV. Changes to the Terms

We may amend, change or update these Terms from time to time at our discretion. You are responsible for checking these Terms periodically and for staying in compliance with them. Your continued use of the Mittai Bandi Platform after any change means you expressly accept the changed Terms and agree to be bound by them.

V. Translation of the Terms

We may provide translations of the English version of these Terms into other languages, such as Telugu, Hindi or others. Any translation is provided only for your convenience. If there is any inconsistency between the English version and a translated version, the English version prevails and governs your relationship with us.

VI. Provision of the Services

Mittai Bandi is constantly evolving in order to give Customers the best possible experience. The form and nature of the Services may change, and we may suspend, cancel or discontinue any or all products or services, or modify any content, products or services on the Mittai Bandi Platform, at any time without prior notice.

The app, or the app store from which you download it, may automatically check for updates and push them to your device. You may be required to install updates in order to continue using the Services (including updates that fix issues with the Services). Updates we provide are part of the Services and subject to these Terms.

By using the Services, you also agree to the following disclaimers:

• Content on the Services is for information only. We do not guarantee the quality of the products, the prices shown on menus, or the availability of every item at any Partner Shop.
• Any licence, certifications or permits (for example, FSSAI registration or licence details) shown on a Partner Shop's page are provided by the Partner Shop and displayed on an “as available” basis for information only. We make no warranty about the validity, authenticity, reliability or accuracy of such information.
• We may charge fees for use of the Platform, such as platform or convenience fees, delivery charges, packaging charges or other per-order charges. Any such fees applicable to your order will be shown to you before you complete payment.

VII. Use of the Services by You or a Customer

1. Mittai Bandi Customer Account

You must create an account to use some features of the Services, including placing orders. Any personal information you give us during account creation is governed by our Privacy Policy. You must keep your password and OTPs confidential and you are solely responsible for the security of your account and everything that happens through it.

When creating an account you confirm that all information you give is true, accurate and complete, and that you will keep it up to date. You may not impersonate anyone, create or use an account for anyone other than yourself, use an email address or phone number that is not your own, create multiple accounts unless we permit it, or provide false information.

2. Other Terms

You agree to use the Services only for purposes permitted by these Terms and applicable law. You agree not to access, or try to access, the Services by any means other than the interface we provide, and will not use automated scripts or web crawlers.

VIII. Content & Intellectual Property

1. Ownership of Mittai Bandi Content and Proprietary Rights

We are the sole and exclusive owners of the copyright in the Services and our Content. We also exclusively own the trademarks, service marks, logos, trade names, trade dress and other intellectual property rights throughout the world (“IP Rights”) associated with the Services and Mittai Bandi Content.

2. Your License to Mittai Bandi Content

We grant you a personal, limited, non-exclusive and non-transferable licence to access and use the Services only as these Terms expressly permit for your personal, non-commercial use.

3. Mittai Bandi License to Your Content

By submitting Your Content (reviews, ratings, photos), you grant Mittai Bandi a perpetual, irrevocable, worldwide, non-exclusive, fully paid-up, royalty-free, assignable, sub-licensable and transferable licence to use Your Content in connection with the Services.

IX. Content Guidelines and Privacy Policy

You confirm that you have read, understood and agreed to our Guidelines and Policies relating to Content, and to our Privacy Policy.

X. Restrictions on Use

You agree not to post or transmit any content (including reviews), or engage in any activity that:

• Violates any law or our Guidelines and Policies;
• Is harmful, abusive, harassing, defamatory, obscene, hateful, vulgar, or invasive of another's privacy;
• Is an inauthentic or knowingly incorrect review;
• Infringes any third party copyright, trademark, patent or trade secret;
• Distributes viruses, bots, scripts, spiders or scrapers;
• Attempts to decompile, reverse engineer, or derive the source code of the Services;
• Threatens the unity, integrity, defence, security or sovereignty of India.

You are strictly prohibited from using the Services to create, host or share any Synthetically Generated Information (AI/deepfakes) that violates law, contains non-consensual imagery, creates false documents, or falsely depicts real individuals.

XI. Customer Feedback

If you send us any ideas, suggestions or documents (“Feedback”), you grant us a binding, non-exclusive, royalty-free, perpetual, global licence to use and develop the Feedback without compensation or confidentiality obligations.

XII. Advertising

Some of the Services may be supported by advertising revenue and may display advertisements and promotions. Deals with advertisers found on the Platform are solely between you and that advertiser.

XIII. Additional Terms and Conditions for Services

1. Sweets Ordering and Delivery

Mittai Bandi provides an online marketplace platform connecting Customers with independent Partner Shops. When you place an order, you give Mittai Bandi an unconditional and irrevocable authorization to place that order with the Partner Shop on your behalf.

Delivery may be carried out directly by the Partner Shop or facilitated through an independent Delivery Partner. In both cases, Mittai Bandi acts as an intermediary. A contract of service is formed between you and the Delivery Partner under the Consumer Protection Act, 2019.

Ingredients, Allergens & Freshness: Sweets and savouries are often made fresh, in small batches, using milk, ghee, nuts, gluten and other ingredients that may cause allergies. It is your responsibility to read the item description, ingredients and allergen information, and store the products as advised. Mittai Bandi is not liable for allergic reactions or dietary non-compliance.

Cancellation & Refund: Governed strictly by our Cancellation and Refund Policy.

2. Food Hygiene Ratings

Hygiene Ratings displayed for Partner Shops are conducted by certified third-party auditors and displayed for information purposes only. Each Partner Shop is solely responsible for maintaining food hygiene and safety standards.

XIV. Disclaimer of Warranties, Limitation of Liability and Indemnification

You agree to indemnify and hold harmless Mittai Bandi, its affiliates, directors, officers and employees from any third-party claims arising from your breach of these Terms, your content, or your violation of applicable law.

XV. Termination of Your Access to the Services

You can delete your account at any time through the app settings or by writing to info@mittaibandi.com. We may suspend or terminate your access immediately if you violate these Terms.

XVI. General Terms

These Terms are governed by the laws of India. The courts at Rajahmundry, Andhra Pradesh, have exclusive jurisdiction over any dispute arising under these Terms, subject to your rights under the Consumer Protection Act, 2019.

XVII. Notice of Copyright Infringement

If you believe your copyright has been infringed, please send a written take-down notification with proof of ownership to legal@mittaibandi.com.
