Mittai Bandi – API Policy

1. Account Creation

You must create an account to use Mittai Bandi's Licensed Content, Marks and API. To create an account you will be asked for basic information including your name, address, organization, telephone number and email address, held in accordance with our Privacy Policy.

2. Purpose

This License Agreement governs your use of the Licensed Content, Marks and API, together with any related documentation, source code, executable applications and materials provided for developing or operating your website or application (the “Developer Platform”).

3. Grant of License

3.1 License to Content: Mittai Bandi grants you a non-transferable, non-exclusive, revocable, non-sublicensable, royalty-free licence to use, perform and display the Licensed Content in your applications (“Developer Application”) on the Developer Platform.

3.2 Licensed Content: Includes sweet shop and product information made available at Mittai Bandi's discretion (names, locations, menus, descriptions, prices, images, ratings). You may make a maximum of one thousand (1,000) calls to the API per day.

3.3 License to Mittai Bandi Marks: Grants you a limited license to display the Mittai Bandi name and logos strictly in accordance with brand guidelines.

3.4 Attribution: Every content page displaying Licensed Content must carry a clear “Powered by Mittai Bandi” attribution with a do-follow link to www.mittaibandi.com opening in a new window, or linking to the app on mobile.

4. Obligations of the Developer

• Developer Platform: You are responsible for all costs and expenses relating to your application and integration.
• Compliance: You must strictly comply with this Agreement, Terms of Service, and Privacy Policy.
• Credentials: API Keys must be kept confidential and safe. You must not share your key with any third party.
• Reporting: Report any security flaws or unauthorized access immediately to info@mittaibandi.com and trademark infringement to legal@mittaibandi.com.
• No Modification: You must not modify the Licensed Content except for layout formatting.
• Data Restrictions: You must not cache, store, pre-fetch, bulk-download, or resell Licensed Content, nor create derivative datasets or commingle it with unlawful content.

5. Absolute Ownership

Mittai Bandi owns and retains all right, title and interest in the Licensed Content, Marks, API, and platform data. User-generated content (reviews, ratings) remains the property of Mittai Bandi.

6. Confidentiality

You must restrict access to Confidential Information to authorized personnel on a strict “need to know” basis. This obligation continues for five (5) years after this Agreement ends.

7. Developer Responsibility

You are fully liable for any breach of this License Agreement or unauthorized use of the API Key committed by your personnel or associates.

8. Use of Developer Trademarks

You grant Mittai Bandi a non-exclusive license to use your name and logo solely to reference the partnership relationship.

9. Independent Parties

This License Agreement is on a principal-to-principal basis and does not create an employment, partnership, or agency relationship.

10. Indemnity and Limitation of Liability

You agree to indemnify and hold harmless Mittai Bandi from any third-party claims arising from your use of the API or Developer Platform. In no event shall Mittai Bandi's aggregate liability exceed INR 50,000 (Fifty Thousand Rupees).

11. Termination

Mittai Bandi may suspend or terminate API access at its sole discretion at any time. Upon termination, you must immediately stop all calls to the API and delete all Licensed Content and keys.

12. Governing Law and Dispute Resolution

This Agreement is governed by the laws of India. Any dispute shall be settled by arbitration under the Arbitration and Conciliation Act, 1996 before a sole arbitrator in Rajahmundry, Andhra Pradesh. The courts at Rajahmundry have exclusive jurisdiction.

13. Warranty Disclaimer & Force Majeure

The API and Licensed Content are provided “AS IS” without warranties of uptime, completeness or accuracy. Performance delays due to acts of God or network outages are excused.
